Jackson County State’s Attorney Michael Carr says a Carbondale police officer’s response to a shooting incident last month behind a local bar was fully justified under the circumstances.
Carr announced his opinion in the case Thursday and added in a letter to Carbondale Police Chief Jeff Grubbs that the ISP captain who supervised the investigation of this case expressed the same opinion.
The Carbondale officer was on patrol in the downtown area around 2:15 a.m. on Oct. 21 when he heard what was believe to be gunshots coming from the area where Curbside restaurant is located at 227 W. Main St.
When the officer arrived, he saw 28-year-old Jeremy Spivey of Marion firing a gun in the direction of a large crowd of people. The officer, in response to the active shooter and to protect the public from possible injury, shot Spivey wounding him.
While awaiting an ambulance, police performed life-saving medical procedures on Spivey. Spivey was flown to a St. Louis area hospital to receive emergency medical treatment.
Police say since this is was an officer-involved incident and in accordance with department policies, Illinois State Police was contacted to lead the investigation.
